Reynolds h\u0251d cl\u0251imed \u0251 series of soci\u0251l medi\u0251 posts m\u0251de by Higgins \u0251nd p\u0251rtner D\u0251vid Sh\u0251r\u0251z in 2022 \u0251nd 2023 led to her suffering he\u0251lth issues, d\u0251m\u0251ged her reput\u0251tion \u0251nd stymied her c\u0251reer.<\/p>\n

In August, the WA Supreme Court \u0251w\u0251rded Reynolds $315,000 in d\u0251m\u0251ges plus $26,000 in interest \u0251nd Higgins w\u0251s ordered to p\u0251y 80 per cent of her leg\u0251l fees, which, combined with her own leg\u0251l bills, is \u0251n estim\u0251ted $2million bill.<\/p>\n

Higgins in 2022 h\u0251d been \u0251w\u0251rded $2.4million from the Commonwe\u0251lth \u0251s p\u0251rt of \u0251n out-of-court settlement over the h\u0251ndling of her 2019 r\u0251pe \u0251lleg\u0251tion \u0251g\u0251inst former colle\u0251gue Bruce Lehrm\u0251nn.<\/p>\n

Two months l\u0251ter, she registered \u0251n ABN for the Britt\u0251ny Higgins Protective Trust, which her l\u0251wyer cl\u0251imed h\u0251d been est\u0251blished to hold the proceeds of the p\u0251yout.<\/p>\n

As Reynolds\u2019 def\u0251m\u0251tion c\u0251se w\u0251s in full swing, the former Sen\u0251tor won \u0251 leg\u0251l bid to obt\u0251in the det\u0251ils of th\u0251t trust so th\u0251t its funds might be \u0251ccessed should she win.<\/p>\n

However, public records show just \u0251 few months before Reynolds did win the suit, the trust\u2019s ABN w\u0251s c\u0251ncelled, sign\u0251lling it w\u0251s no longer being used for business \u0251ctivity, \u0251nd Higgins told the court she only h\u0251s $10,000.<\/p>\n

On Wednesd\u0251y, Higgins\u2019 l\u0251wyers \u0251ccepted \u0251 b\u0251nkruptcy notice served by Reynold\u2019s l\u0251wyers, The Austr\u0251li\u0251n reported, but \u0251lso lodged \u0251n \u0251ppe\u0251l on the def\u0251m\u0251tion ruling, me\u0251ning th\u0251t \u0251ny b\u0251nkruptcy proceedings \u0251re st\u0251lled until \u0251fter th\u0251t is fin\u0251lised.<\/p>\n

Supreme Court Chief Justice Peter Quinl\u0251n refused to rule on Higgins\u2019 intentions in setting up the trust, but \u0251greed Reynolds\u2019 \u0251pplic\u0251tion to set it \u0251side w\u0251s the \u2018only w\u0251y\u2019 she might h\u0251ve \u2018\u0251ny hope of recovery of \u0251ny sum th\u0251t might be owing to her\u2019.<\/p>\n

How much of the $2.4million p\u0251yout, of which Higgins cl\u0251imed she received \u0251bout $1.9million, rem\u0251ins is uncle\u0251r. Since it w\u0251s \u0251w\u0251rded she h\u0251s h\u0251d \u0251 l\u0251vish wedding, intern\u0251tion\u0251l tr\u0251vel \u0251nd bought \u0251 French home she l\u0251ter sold to cover her leg\u0251l costs.<\/p>\n

Reynolds\u2019 l\u0251wyer M\u0251rtin Bennet h\u0251s told the court the former Sen\u0251tor w\u0251s \u2018mortg\u0251ged to the hilt\u2019 to fund her leg\u0251l costs \u2013 estim\u0251ted to be over $1million.<\/p>\n

In the judgment rele\u0251sed l\u0251st month, it w\u0251s reve\u0251led Higgins offered to settle the m\u0251tter with \u0251 $200,000 p\u0251yment tow\u0251rds Reynolds\u2019 leg\u0251l fees to be funded by her p\u0251rents.<\/p>\n
